In Florida, the legislature has set a range of punishments for different drug offenses.  The potential punishment for various drug charges can vary depending on the type and amount of the controlled substance and the degree of the misdemeanor or felony.  A Second Degree misdemeanor may lead to a jail sentence of up to sixty (60) days whereas a First Degree misdemeanor can result in a jail sentence of up to one (1) year.

A Third Degree felony drug possession charge can carry a prison term of up to five (5) years with a Second Degree felony charge carrying a term of imprisonment of up to fifteen (15) years.

Florida also has "career criminal" and "habitual felony offender" statutes which can increase the penalties.    Although drug possession convictions may not enhance a sentence it can certainly affect future sentencing should an individual re-offend.
